1. Introduction

These Terms and Conditions of Ausmora (hereinafter referred to as the "Terms and Conditions") govern the use of Ausmora (hereinafter referred to as the "Site") and its services by users (hereinafter referred to as the "User", "you", "your"). The Site is provided by Ausmora Astrotech IT L.L.C (hereinafter referred to as the "Company", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Site.

Recitals

  • A. The Company is engaged in the development and operation of Ausmora, which offers services such as Vastu consultation and astrology consultation to assist users in personal insights, guidance related to astrology and related practices.
  • B. The user acknowledges that by accessing or using the Site, they are entering into a legal agreement with the Company and agree to comply with the Terms and Conditions set forth herein.

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree to the following Terms and Conditions for the use of the Site.

2. License Grant

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Site for your personal or internal business purposes or academic purposes.

3. Service Provided

The Site offers services including, but not limited to, Vastu consultation, astrology consultation, Rituals & Puja Booking (the "Services"). These Services are intended for personal or internal business purposes or academic purposes only and should not be considered a substitute for medical treatment or any other related expert guidance.

4. User Obligations

Users agree to:

  • 4.1. Use the Site and Services only for lawful purposes and in accordance with these Terms.
  • 4.2. Not use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
  • 4.3. Provide accurate and up-to-date information when using the Services.

  • 4.7. Not attempt to gain unauthorized access to the Company's systems, attack the Company's infrastructure, transmit malicious code, abuse payment systems.
  • 4.8. Not use the Services to commit any illegal activities in the context of civil, criminal, or any other related legal aspect.
  • 4.9. Not share unlawful or objectionable content, spread viruses or harmful content, engage in pyramid schemes or similar activities, misrepresent themselves or others, create accounts in bulk without approval, violate the legal rights of others, promote illegal activities or human trafficking, interfere with the Services or create undue burdens, attempt to modify, reverse engineer, or remove proprietary notices from the Services, or use the Services for sending unsolicited messages.
  • 4.10. Not upload or transmit content that violates third-party rights (including copyrights), is excessively vulgar or promotes hate or violence, advocates for illegal activities or computer hacking, involves drug paraphernalia, malicious content, or illegal gambling, contains nudity, sexually explicit material, or promotes self-harm.

5. Intellectual Property Rights

All intellectual property rights in the Site and its content are owned by the Company. User acknowledges that you do not acquire any ownership rights by using the Site.

6. Data Storage and Usage

The Company reserves the right to collect and store data provided by users while using the Site. This data shall be used to improve the functionality and performance of the Site, enhance user experience, and provide better results for customers. The Company will handle all data in accordance with its Privacy Policy. The company reserves the right to store the data even after the termination.

7. Disclaimers

The Site and Services are provided on an "as-is" and "as-available" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the Site or Services, including but not limited to their accuracy, reliability, or availability.

8. Warranties

8.1. Each Party warrants that it has the legal authority to enter into this Agreement.

8.2. User acknowledge that the Company does not warrant that the:

  • 8.2.1. The use of the Site will be secure, timely, uninterrupted, or error-free, or that it will operate in combination with any other hardware, software, system, or data.
  • 8.2.2. The Site or Services will meet your requirements or expectations.
  • 8.2.3. Any data stored through the use of the Site will be accurate or reliable.
  • 8.2.4. The Site and the Services will be error-free or that all errors or defects will be corrected.
  • 8.2.5. The Site or the servers that make it operate are free of malware or other harmful components.

By using the Site and its services, you represent and warrant that you are at least 16 years old and meet the minimum age requirements regarding digital consent under applicable laws to form a binding contract with the Company. If users are at least 16 years old but not old enough to consent to this Agreement pursuant to applicable laws, their parent or guardian must agree to this Agreement on the user's behalf. Such parent or guardian must read the terms and conditions set forth in this Agreement, which apply to them. Thus, a parent or guardian giving consent on behalf of a teenager is responsible for any actions committed by such a teenager while using the Site.

You acknowledge that the Site may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. The Company is not responsible for any delays, delivery failures, or other damages resulting from such problems.

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services, even if the Company has been advised of the possibility of such damages.

User agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or Services or your violation of these Terms.

13. Restrictions and Prohibitions

Users must refrain from actions that could harm themselves or others, including attempting to access other users' accounts, infringing on intellectual property rights, or engaging in harassment, bullying, or spamming.

13.2. Harm to the Company

Users must not attempt to gain unauthorized access to the Company's systems, attack the Company's infrastructure, transmit malicious code, abuse payment systems, or misuse the Company's intellectual property and customer service mechanisms.

13.3. Illegal Use of Services

Users must not use the Services to commit any illegal activities or infringe on the intellectual property rights of others.

13.4. Prohibited Actions

Users are prohibited from:

  • Sharing unlawful or objectionable content.
  • Spreading viruses or harmful content.
  • Engaging in pyramid schemes or similar activities.
  • Misrepresenting themselves or others.
  • Creating accounts in bulk without approval.
  • Violating the legal rights of others.
  • Promoting illegal activities or human trafficking.
  • Interfering with the Services or creating undue burdens.
  • Attempting to modify, reverse engineer, or remove proprietary notices from the Services.

13.5. Prohibited Content

Users are prohibited from uploading or transmitting content that:

  • 17.2. Severability: If any provision is found invalid or unenforceable, it will be modified to reflect the original intent, and the remaining provisions will remain in effect.
  • 17.3. Informal Resolution: Users should consult the Company to resolve disputes initially.
  • 17.4. Publicity: With written consent, the Company may use the User's name and trademarks for business development and marketing purposes.
  • 17.5. Force Majeure: Neither party is liable for delays or failures due to events beyond their control.

Declaration
